Why Sales Get Delayed
Property transactions in England and Wales are notoriously slow. The average time from offer acceptance to completion is twelve to sixteen weeks — and many transactions take significantly longer. Understanding the most common causes of delay helps sellers take action to keep their sale moving.
Slow Solicitors
The most commonly cited cause of delay is slow conveyancing. Some solicitors carry very high caseloads and are slow to respond to enquiries, prepare documents, or progress the transaction. Sellers can reduce this risk by choosing a solicitor with a good reputation for responsiveness, instructing them early, and maintaining regular contact throughout the process.
Incomplete or Inaccurate Property Information
If the property information forms are incomplete, inaccurate, or raise questions that require further investigation, the buyer's solicitor will raise additional enquiries. Each round of enquiries adds time to the transaction. Sellers who prepare their property information thoroughly before marketing — and who respond to enquiries promptly — can significantly reduce this source of delay.
Missing Documents
Many transactions are delayed by missing documents — planning permissions, building regulations certificates, guarantees for work carried out, or evidence of compliance with lease terms. Gathering these documents before marketing, rather than scrambling to find them after an offer is accepted, is one of the most effective ways to speed up the conveyancing process.
Search Delays
Local authority searches are a standard part of the conveyancing process and are ordered by the buyer's solicitor. In some areas, searches can take several weeks to come back. This is largely outside the control of either party, though some buyers choose to use personal search companies that can return results more quickly.
Mortgage Delays
If the buyer is using a mortgage, the lender's valuation and mortgage offer process can add several weeks to the transaction. Delays in the mortgage process are often caused by the buyer's circumstances — incomplete applications, missing documents, or changes in their financial position. Sellers can reduce this risk by choosing buyers who have already obtained a mortgage in principle.
Chain Delays
In a chain, the transaction can only proceed at the pace of the slowest link. A delay anywhere in the chain — a slow solicitor, a missing document, a mortgage problem — affects every other transaction in the chain. Sellers who are in a chain have limited control over delays caused by other parties, but can ensure that their own part of the transaction is progressed as quickly as possible.
Leasehold Complications
Leasehold transactions typically take longer than freehold ones. The buyer's solicitor will need to review the lease, obtain a management pack from the freeholder or managing agent, and raise additional enquiries about service charges, ground rent, and building insurance. Sellers of leasehold properties should instruct their managing agent to prepare the management pack as early as possible.
What Sellers Can Do
The most effective things a seller can do to reduce delays are:
- Instruct a solicitor before going to market
- Prepare property information forms and gather supporting documents before marketing
- Respond to all solicitor requests promptly
- Maintain regular contact with your agent and solicitor
- Chase your solicitor if you have not heard from them for more than a week
- If you are in a chain, ask your agent to monitor the progress of the whole chain
